Nadi Magistrate Siromi Turaga’s absolution of two men who conceded to breaking time limitation, has been named as wrong and imperfect.

In one body of evidence against two blamed, the judge decided that the indictment depended on an announcement by the Prime Minister and not the forces of the Minister for Health who is liable for the Public Health Act 2020.

The Magistrate expressed that indictment charged the two on non-existent law and that the charge is flawed.

In another issue, Turaga expressed that the Public Health Act vests no such capacity to the Prime Minister and any choice that radiates from his mandate is unlawful.

Lawyer General Aiyaz Sayed-Khaiyum has come out firmly against the decision saying the Magistrate missed the substance of the issue and didn’t think about the Gazette when making the decision.

He says to guarantee that these declaration by the Prime Minister weakens the legitimate standing is ridiculous.

The imperfect choice by the Magistrate in Nadi, not the slightest bit imperils the enforceability of the Fijian government’s wellbeing security orders. These mandates are sparing lives, Fijians experience each day and the individuals who disregard these orders will keep on being captured and arraigned. Notwithstanding who reports these mandates legitimate specialists rest with the Minister for Health and the PS for Health which no one has usurped? In the interim, with the eyes of the country the Prime Minister for unequivocal initiative any progressions under the Public Health Act will be declared by him so it contacts the vastest conceivable crowd and is given the most extreme consideration.”

Sayed-Khaiyum adds it is upsetting to take note of that the Magistrate neglected to consider, not to mention allude to these requests despite the fact that they were distributed eleven days before his decision and the people were charged six days after the production of the requests.

The Attorney General affirms the decision will be claimed and applicable conversations are in progress between the Fiji Police Force and the Director of Public Prosecutions Office.
