Suva Magistrate Yogesh Prasad will decide on the 25th of next month whether to transfer the case of Sayed Khaiyum and Saneem to the High Court.
Both cases were called for a ruling on the application of consolidation of charges presented by the defense.
Defence lawyer Devanesh Sharma suggested that the consolidation application would be on hold until they discussed Saneem’s separate application.
Acting DPP Nancy Tikoisuva stated that the Magistrate does not have jurisdiction to decide on constitutional redress cases. They are only heard in the High Court.
Sayed-Khaiyum is charged with abuse of office, while Saneem is charged with receiving a corrupt benefit.
