Mother In Court For Allegedly Raping, Assaulting Daughter

Updated: 6:35am – A state lawyer in the case against a 45-year-old woman who allegedly raped and assaulted her 14-year-old daughter last year told the Court that they were ready for trial.

The woman appeared before Suva High Court Judge Justice Salesi Temo and was represented by Legal Aid lawyer Lavinia David.

Ms David had informed Justice Temo that the defence was ready to go to trial.

It is alleged that between January 1 and July 5, 2016 at Nasinu the woman had sexual relations with her teenage daughter.

The accused was denied bail on the last occasion after Justice Temo ruled that there was no reason for her to access her liberty because of the allegations against her from her daughter.

Her trial is set to begin on November 6 this year.

The accused was further remanded in custody pending trial.

Alleged Navua infanticide pre-trial date set for February

Defence counsel for a 39-year-old Navua woman charged with the alleged murder of her seven-day-old baby boy filed for her guilty plea to be vacated.

In the Suva High Court yesterday, Ms Lavinia David submitted that Section 244 of the Crimes Act states that a woman conducts an indictable offence of infanticide if the child is under the age of 12 months.

Ms David submitted that in the case of her client Tavenisa Raceva the child was seven-days-old.

Judge Justice Salesi Temo granted the application and the charge was read out to the accused again in Court to which she entered a not guilty plea.

The case is adjourned to February 12 next year for pre-trial conference. where the prosecution is expected to outline their theory of the case and present the type of evidence they intend to rely on to grant a possible conviction.
