Updated: 7:42am – A 33-year-old man who has been standing trial accused of raping his ex-wife told the court that his ex-wife has been making false allegations against him.
The accused is charged with four counts of rape.
The matter was being heard before Judge Justice Riyaaz Hamza at the Suva High Court .
He is alleged to have raped his wife with an eggplant.
The alleged incident occurred between November 30, 2015 and January 5, 2016.
Defence lawyer Talei Kean questioned the accused who gave evidence from the witness stand about the events that transpired after the accused found out about his ex-wife’s second affair.
The accused told the court that he told his wife to leave her job as she had made too many mistakes and that if she made another mistake he would leave her and go away.
“I told my wife that from now onwards if you make a mistake I will tell your sister and friend that for your freedom you are sending me to prison,” the accused said.
“Every time I found out about her affairs she used to report to the police putting false allegations that I was threatening her and I used to be sent to prison for breach of the DVRO (Domestic Violence Restraining Order) and she enjoyed her life.”
The accused told the court that the two times he had gone to prison due to the breach of DVRO, his wife had affairs with two different men.
He also told the court that on one occasion while having sex with his ex-wife she uttered the words ‘I love you’ with his cousin’s name.
Ms Kean asked him how he had felt after that to which he said he felt bad as it had never happened before in the past nine years of their marriage.
“When the Police came to my house my wife showed them the DVRO paper and told them that I was threatening her and she then told the police that I used an eggplant on her,” he said.
“I told the Police that she was lying and that she is saying all this because I have come to know of her affairs and to stop me from telling anyone she is putting false allegations on me.”
The accused told the court that he had never used an eggplant on his ex-wife and always had normal sexual intercourse with her.
“Whenever she reports against me the Police never listen to me and put me in prison,” he said.
The accused will be cross-examined on Monday by the prosecution.
